European X-Ray Free-Electron Laser Facility GmbH (European XFEL) is a non-profit limited liability company under German law. It operates the world’s largest X-ray laser, a 3.4-kilometre-long facility from the DESY campus in Hamburg to Schenefeld in Schleswig-Holstein. The laser generates ultrashort X-ray flashes 27,000 times per second, with a peak brilliance a billion times higher than that of the best conventional X-ray sources.
The European XFEL is announcing a tender for the development and supply of superconducting undulator (SCU) modules as part of an afterburner project for the Hard X-ray line SASE2. This project will comprise a small series of SCU modules, with one module retained for measurement-system improvements and as a spare. The modules are designed to produce X-ray lasing at photon energies of ≥ 25 keV while operating at an electron beam energy of 16.5 GeV.

The documents which the applicant must enclose with its application to participate are listed below. For this purpose, the applicant must use the forms (application documents) provided by the contracting authorities. Submitted supporting documents must still be valid; insofar as requirements are made regarding up-to dateness, the date refers to the date of publication of this notice. In the case of applicant consortia, the suitability requirements PL1 to PL3 listed here apply mutatis mutandis to each individual member of the applicant consortium. Reliance on the capacities of third parties is excluded in respect of the evidence required under PL1 to PL3.
With their request to participate, applicants must submit the following documents:
PL1. Self-declaration regarding exclusion criteria (Sec. 123, 124 GWB). A form is included in the application documents.
PL2. Self-declaration on the company with information on the company name, legal form, registered office, object, management of the company, company structure (e.g. parent companies, group affiliation, branches - organization chart), with presentation of the company and capital relationships of the applicant and, if applicable, the responsible branch office and query on SME status as well as beneficial owner(s) of the company.
PL3. Self-declaration on the EU packages of sanctions implementing Article 5k, paragraph 1 of the Council Regulation (EU) No 833/2014 (“RUS sanctions”). A form is included in the application documents.
In the case of applicant consortia, the evidence must be provided by each member of the applicant consortium.
WL. Self-declaration concerning the economic and financial
capabilities of the applicant, in particular statement of total turnover of the applicant of the last
3 financial years. The form in the application documents shall be used. In the case of applicant consortia, the evidence can be provided for the applicant consortium in total. In the case of a loan of qualifications, particularly where subcontractors are involved, the relevant supporting documents must be submitted for the relevant companies. If an applicant is unable to provide any required evidence for a valid reason, it may demonstrate its ability to perform by submitting other appropriate evidence. EuXFEL reserves the right to request further self-declarations and certificates for applicants selected at the end of the call for competition and any subcontractors upon separate request with the submission of the offer.
EuXFEL reserves the right to obtain financial information on the applicant
TL: List of references concerning the performance of services comparable to the contract to be awarded (self-declaration) over the last 15 years (cut-off date: 1 November 2011). For this purpose, the applicant must use the forms (application documents) provided by the contracting authorities. Please attach descriptions of the respective contracts from which the comparability of the reference with the contract that is the subject of this procurement can be derived. In the case of applicant consortia, corresponding information may be provided for the applicant consortium as a whole. The contracting authority may require the submission of reference certificates issued by the respective reference clients. Minimum requirements for the references: evidence of at least two comparable references from the last 15 years (cut-off date: 1 November 2011).
Where more than three applicants meet the suitability criteria, the contracting authority will rank the qualified applicants against each other solely on the basis of the references submitted under TL in order to select the candidates to be invited to submit an initial tender. For this purpose, the criteria PL1, PL2, PL3 and WL will not be evaluated.
The information and evidence listed under TL are used to assess the references. A maximum total of 100 points can be achieved here. The evaluation of technical and professional ability is carried out in a relative comparison of the applicants with each other on the basis of the following scale/grade levels.

In the range between 0 points and 100 points, intermediate grade levels can be formed (10points, 30points, 50points, 70points, 90points) to take into account a tendency towards the higher grade level in each case. An evaluation of a suitability criterion (technical and professional ability) with 20 points or less would correspond to a complete non-fulfillment of the respective suitability criterion, which would result in the exclusion of the participation application (knock-out criterion).
These are suitability criteria, not award criteria.
If several applicants achieve the same total score and the number of applicants exceeds the planned number of bidders to be invited to negotiate, European XFEL reserves the option to draw lots for the negotiation procedure among the remaining applicants with equal scores.

- Sec. 134 para. 2 GWB - Obligation to inform and standstill period: A contract may not be concluded until 15 calendar days have elapsed after the dispatch of the information pursuant to Sec. 134 para. 1 GWB. If the information is sent electronically or by fax, this period is reduced to 10 calendar days. The period begins on the day following the dispatch of the information by the contracting authority; the day on which the information is received by the tenderer or applicant concerned is not relevant. - The award procedure is subject to the provisions governing the review procedure before the Public Procurement Tribunal (Sec. 155 et seq. GWB). The time-limit for appeal is regulated under Sec. 160 para. 3 GWB. The application is inadmissible if: 1) The applicant became aware of the alleged violation of provisions governing the awarding of public contracts before submitting the appeal and did not object to the contracting entity within 10 calendar days; the deadline stipulated in Sec. 134 para. 2 remains unaffected; 2) Violations of provisions governing the awarding of public contracts which become apparent from the tender notice are not notified to the contracting entity by the end of the period specified in the notice for the submission of a tender or application; 3) violations of provisions governing the awarding of public contracts which only become apparent from the award documents are not notified to the contracting entity by the end of the period specified in the notice for the submission of a tender or application; 4) More than 15 calendar days have elapsed from the receipt of notification from the contracting entity that it is unwilling to redress the complaint; 5) there is a manifest abuse of the right to apply for review or to lodge an appeal pursuant to Section 180(2) of the German Act against Restraints of Competition (GWB). The above sentence does not apply to an application for a declaration of invalidity of the contract pursuant to Sec. 135 para. 1 no. 2 GWB. Sec. 134 para. 1 sentence 2 GWB remains unaffected.
